Settlement Amounts
HOW DO I LEARN MY ESTIMATED SETTLEMENT AMOUNT? If you are
a member of the Settlement Class, you may learn your estimated individual
settlement amount, details about the records used to calculate your estimated
individual settlement amount, the total payout to Class Members, and the mean
and median payouts by calling the Class Administrator at 1-877-526-1011.
For an explanation of the method used for calculating your estimated individual
settlement amount, and for additional information to place your estimated
individual settlement amount in context, please review the Sample Calculations
available at the link on the right side of the Main Page of this website.
NOTE: The method used for calculating estimated individual settlement
amounts is the same method that was originally described in the Notice of
Proposed Class-Action Settlement and Fairness Hearing. The Class
Administrator's calculations are estimates based on information available as of
June 16, 2008. These estimates are based on several assumptions that are
subject to minor revision. For example, the exact amount of future settlement
administration expenses, interest earned by the Settlement Fund, and taxes due
on that interest, are not presently known. Additionally, estimated settlement
amounts may be subject to revision if any calculation errors are discovered.
WHAT IF I BELIEVE AN ERROR HAS BEEN MADE IN CALCULATING MY ESTIMATED INDIVIDUAL
SETTLEMENT AMOUNT? The deadline for claiming an error in the
calculation of your settlement amount expired on July 14, 2008. Prior to that
date, if you believed an error had been made in your estimated settlement
amount, you were required to bring your concerns to the attention of the Class
Administrator in writing, postmarked on or before July 14, 2008, at
Complete Claim Solutions, LLC, P.O. Box 24786, West Palm Beach, FL 33416. Such
submissions were required to state in writing the claimed error and attach any
data, documents or other evidence that support the claim. The Class
Administrator was required to respond to all timely submissions.
If a Class Member was not satisfied with the Class Administrator's decision and
wished to submit its claim of error to the arbitration panel, the Class Member
was required to notify the Class Administrator in writing at Complete
Claim Solutions, LLC, P.O. Box 24786, West Palm Beach, FL 33416 within ten (10)
business days of the mailing of the Class Administrator's decision. The Class
Administrator was to arrange for all materials to be forwarded to the
arbitration panel, which would have resolved the issues submitted.
